These Terms of Use (“Terms”) govern your access to and use of www.brickclay.design (the “Site”) and all services, subscriptions, and engagements provided by Brickclay LLC (“Brickclay,” “we,” “us,” or “our”). By accessing or using our Site or Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.
You must be at least 18 years old and legally authorized to enter into binding agreements. If using the Services on behalf of an organization, you represent that you have authority to bind that entity.
Brickclay provides subscription-based and project-based creative services including design, UI/UX, motion design, branding, and digital services. All Services are subject to availability and capacity.
To access subscription plans, you must create an account and provide accurate billing information. You are responsible for maintaining accurate account details and safeguarding credentials.
All subscriptions renew automatically. By purchasing a subscription, you authorize Brickclay and its payment processor (e.g., Stripe) to automatically charge your selected payment method on a recurring monthly or annual basis at the start of each billing cycle until you cancel. Failure to cancel before renewal will result in automatic billing for the next cycle.
We do not offer automatic self-serve free trials. If you are interested in exploring a trial engagement, please contact us directly to discuss eligibility and terms.
Any approved trial will be confirmed in writing, including scope, duration, and any applicable conditions. No subscription fees will be charged unless and until you explicitly agree to move forward with a paid plan.
All fees are billed in advance. Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for all applicable VAT, GST, sales tax, or similar taxes. If required to withhold taxes under local law, you remain responsible for the full contract amount.
All pages on the Site are served over HTTPS. Payments are encrypted and securely handled via Stripe.
Refunds are available only within seven (7) calendar days of initial purchase. After this period, no refunds, prorated credits, or partial refunds will be issued. Cancellation prevents future billing but does not refund prior charges. The refund process is not automated.
You agree to contact Brickclay before initiating a chargeback. Unjustified chargebacks may result in suspension, termination, and recovery of dispute fees.
Upon full payment, you own final approved deliverables. Brickclay retains rights to internal systems, drafts, templates, and portfolio use of non-confidential work.
You may not violate laws, attempt unauthorized access, reverse engineer systems, resell subscriptions, upload malicious code, or infringe third-party rights.
Both parties agree to maintain confidentiality of non-public information shared during engagement, except where disclosure is required by law.
Subscriptions do not include paid advertising management, backend infrastructure engineering, database architecture, or legal/financial advisory services.
To the maximum extent permitted by law, Brickclay shall not be liable for indirect or consequential damages. Total liability shall not exceed fees paid in the three (3) months preceding the claim.
Either party may terminate at any time. Access ceases at the end of the billing period. Brickclay may terminate immediately for non-payment, fraud, or policy violations.
Brickclay may update these Terms periodically. Continued use after updates constitutes acceptance.
